Judge Rules on Government/Big Food Lawfare Attack on Amish Farmer
Editor’s Note: Readers who are not aware of this story should start with our previous piece on the outrageous thuggery being used against Amish farmer Amos Miller HERE.
There is no law saying that you cannot eat food that you grow for yourself. There is no law saying that you cannot buy food directly from a farmer.
The US Department of Agriculture (DoA) tried to change that by raiding and waging lawfare against Amos Miller. The DoA was hoping that Miller, being Amish, would not fight back and they could get a precedent in court to use against other small farmers.
Fortunately, some powerful civic minded lawyers, including famed litigator Robert Barnes, saw what the government was trying to do and came to Amos Miller’s defense. Barnes even set up a discount public interest law firm to help protect small farmers from lawfare attacks.
After the federal government was defeated in court, the Pennsylvania Department of Agriculture raided Amos Miller. To justify the warrant, they lied to a local judge claiming that people were getting sick from Amos Miller’s food and that he was in violation of Pennsylvania Department of Agriculture regulations.
The problem that Penn DoA has is that exactly zero of their allegations withstood even cursory cross examination in court, their witnesses were caught lying on the stand and …and you can’t make this stuff up… the legislature has never passed laws authorizing the powers and regulations that Penn DoA is asserting in court.
The judge asked the Penn DoA to let it go. They refused. So, the judge tossed out all of the actions against Amos Miller EXCEPT that he is not allowed to sell raw milk or raw milk products - which still has no basis in Pennsylvania law. Barnes is filing an appeal.
Were any sanctions brought against Penn DoA and prosecutors for the fraud they put in front of the court? Of course not. Why are so many judges afraid of ruling against the government?
Watch the video with Robert Barnes below to see just what a malicious joke of a case the Penn DoA tried to get away with on behalf of BigFood.
Amos Miller in the meantime has not only been shut down, but his defense and being shut down will likely cost almost a million dollars. There is a GiveSendGo set up for Amos HERE.
