New Mexico Governor Suspends Second Amendment by Decree for "Public Health."
COVID lockdown decree's taken to the next level.
The Democrat Governor of New Mexico Michelle Lujan Grisham has decided to take “law by decree for public health” to the next level by suspending the right to bear arms for public health reasons.
The goal seems to get the courts to create precedent by pushing for a “public health decree” for guns deemed legal.
Ruling by decree may sound farfetched but unfortunately several judges, including Supreme Court Justice Amy Coney Barrett when she served in the 7th Circuit Court of Appeals, ruled that the Illinois Governor may rule by decree, even many months after the state legislature does nothing, to enforce COVID lockdowns against the governor’s political enemies and make exceptions for political allies “because it is an emergency” in spite of the fact that no “emergency” or “public health” exceptions are allowed by the constitution. In fact, separation of powers in the constitution prevents governors and presidents from legislating (creating law) in the first place as that power is restricted to the legislature.
NOTE - It is for this reason that we strongly opposed Barrett’s nomination as the uniparty and the administrative state pushed for her hard.
Governor Grisham and her attorneys seem to have taken the view that if separation of powers, the right to travel, assemble, the right to pursue happiness, equal justice under law, and the Bill of Rights can all be tossed out the window for “public health” is this really a stretch?
While several courts waved the judicial magic wand as Amy Barrett has, other courts have refused to go along with it.
The news is not all bad. In recent months the court’s tolerance for executive branch agencies being allowed to have their own “administrative courts” and to make law on their own has run thin after several agencies, including the BATF, failed to grasp the concept of “too far” and generated massive legal push back by citizens and Congress.
