This is one of the biggest stories affecting our economy and it has gotten very little coverage.
It used to be that if you were in inventor or a company researching various forms of technology; you would get a patent lawyer and file your patent with the U.S. Patent Office. The courts with real judges and real juries would protect your patents and would award you damages if your patent was infringed.
Because of a patent system that protected intellectual property the United States became an engine for creating new technologies.
No more.
As a result of lobbying from Google, regular courts no longer handle patent cases. Now an administrative court handles the cases without regular judges and no jury.
Guess who the head of the new patent administrative court system is. You guessed it, the former patent lawyer for Google.
The “judges” in the new system get bonuses for stripping people of their patents and do so 84% of the time. Much of the time it is Google who is stealing patents and using this administrative court to strip smaller companies and individuals of their intellectual property.
Now smaller companies and individuals are moving away from the U.S. Patent system and going to other countries. Even China’s patent system, which has been justly criticized, offers more protection than the current U.S. system.
Roman Balmakov speaks with Randy Landreneau who is working to get the old patent system back. If it is not fixed, research and development will continue to flee from the United States.
